Second DUI

If you or someone you know has been arrested and charged with a second DUI, the following criminal sentences are possible if found guilty.

Second DUI with a blood alcohol content of .08% to .15%

  • Between 30 days and 1 year in jail
  • Between $500 to $5,000 fine
  • License Suspension from 2 years to 900 days
  • Ignition Interlock Device Required
  • Judge may require chemical dependency evaluation from a state-approved agency and require completion of any recommended treatment from the agency.

Second DUI with a blood alcohol content of greater than .15%, or refusal to take test

  • Between 45 days and 1 year in jail
  • Between $750 and $5,000 fine (usually around $1,150)
  • License revocation for 2 years
  • IID required
  • Judge may require chemical dependency evaluation from a state-approved agency and require completion of any recommended treatment from the agency.
